Terms of Service

These Terms of Service ("Terms") govern access to and use of DeckBid Express ("DeckBid Express," "the Service," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you" or "your company"). If you do not agree, do not use the Service.

1. The Service

DeckBid Express is a cloud-based estimating and proposal tool for deck and construction businesses. It helps you build material and labor catalogs, generate client estimates and proposals, collect e-signatures, and manage related business records (clients, contractors, company documents, and team members).

2. Accounts & Eligibility

You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for all activity under your account, including actions taken by employees or team members you invite. You must be authorized to accept these Terms on behalf of your business.

3. Subscription, Trial & Billing

• New accounts begin with a 7-day free trial. No charge occurs until the trial ends, unless you cancel first.
• After the trial, the subscription is billed at the plan selected at signup (currently $499.00/year or $200.00/quarter for the first team member), plus $25.00/month for each additional team member added to your account.
• Subscriptions renew automatically at the end of each billing period unless canceled beforehand. You can cancel or manage billing at any time from within the Service.
• Fees are billed in advance and are non-refundable except where required by law.
• Payments are processed by Stripe. DeckBid Express does not store your full payment card details.
• We may change pricing for future billing periods with reasonable advance notice.

4. Your Data & Content

You retain ownership of the data you and your team enter into the Service — including client records, estimates, proposals, materials catalogs, contractor records, photos, and documents ("Your Data"). You grant us a limited license to host, store, process, and display Your Data solely to operate and improve the Service on your behalf. You're responsible for having the right to enter any client, contractor, or third-party information you upload, and for complying with applicable law when doing so.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any account, system, or data; reverse-engineer or resell the Service without our written consent; upload malicious code; or use the Service in a way that disrupts it for other customers.

6. Third-Party Services

The Service relies on third-party infrastructure providers to operate, including Stripe (payments), Supabase (database and file storage), and Netlify (hosting). Use of the Service is also subject to those providers processing data as described in our Privacy Policy.

7. Service Availability & Changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, add, or remove features at any time. We'll make reasonable efforts to notify you of material changes that affect how you use the Service.

8. Termination

You may cancel your subscription at any time; access continues through the end of the paid period. We may suspend or terminate accounts that violate these Terms or have significantly overdue payment. Upon termination, we will retain Your Data for a reasonable period to allow export, after which it may be deleted.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. Estimating calculations and proposal templates are tools to assist your business — you remain responsible for the accuracy, pricing, and legal sufficiency of any estimate, contract, or proposal you send to your clients.

10. Limitation of Liability

To the fullest extent permitted by law, DeckBid Express will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold DeckBid Express harmless from claims arising out of your use of the Service, Your Data, or your violation of these Terms or applicable law.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Virginia.

13. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
